By accessing or using Vibe Typer (“Service,” “Application,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Vibe Typer is a desktop application that provides:

• Lightning-fast speech-to-text transcription
• AI-powered text enhancement and editing
• Cross-platform text insertion capabilities
• Voice command processing
• User account management and usage tracking

3. Eligibility

3.1 Age Requirements

You must be at least 16 years old to use this Service. If you are under 16, you may not use the Service or provide any personal information.

3.2 Legal Capacity

You must have the legal capacity to enter into binding agreements in your jurisdiction.

3.3 Prohibited Users

You may not use the Service if you are:

• Prohibited by law from using the Service
• Previously banned from using the Service
• Acting on behalf of competitors for competitive intelligence purposes

4. User Accounts

4.1 Account Creation

To use the Service, you must:

• Create an account with a valid email address
• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use

4.2 Account Responsibility

You are responsible for:

• All activities that occur under your account
• Maintaining the confidentiality of your login credentials
• Ensuring your account information remains current and accurate

4.3 Email Communications

By creating an account with Vibe Typer, you may receive service-related emails, including:

• Account-related notifications and security alerts
• Billing and subscription notices (if applicable)
• Important product and service updates

You cannot opt out of essential service emails.

5. Pricing and Payment

5.1 Free Plan

New users receive 1,000 words of transcription per calendar month. Time saved metrics shown in the app are for productivity insights only and are not used to determine free plan limits.

How Time Saved is Calculated (Analytics Only):

• For Speech Transcription: Time saved = (Words ÷ 40 WPM typing speed) - Actual speaking time
  • Your personal speaking rate is tracked from your transcription history
  • Default assumption: 150 words per minute speaking rate for new users
  • Example: Speaking 30 words in 10 seconds saves ~35 seconds (30 words ÷ 0.67 words/sec - 10 seconds)
• For AI Operations: Time saved = AI-generated words ÷ 0.67 words per second
  • Accounts for the time you save by not having to type the AI-generated content
  • Based on the actual words generated by AI features (reply and rewrite modes)
  • Example: AI generates 80 words = 119 seconds (nearly 2 minutes) of time saved

5.2 Paid Services

After using 1,000 words of transcription in a calendar month on the free plan, continued transcription requires payment according to our current pricing structure available at https://vibetyper.com/#pricing.

5.3 Billing

• Charges are billed according to your selected plan
• All fees are non-refundable unless otherwise stated
• We reserve the right to change pricing with 30 days notice
• Failed payments may result in service suspension

6. Acceptable Use

6.1 Permitted Uses

You may use the Service for:

• Personal productivity and transcription needs
• Commercial and business purposes
• Educational and research activities
• Creative and professional content creation

6.2 Prohibited Uses

You may not use the Service to:

• Transcribe illegal content or engage in illegal activities
• Distribute copyrighted material without permission
• Create, distribute, or store harmful, threatening, or offensive content
• Violate any applicable laws or regulations
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to the Service
• Use the Service for competitive intelligence or reverse engineering
• Transmit viruses, malware, or other harmful code

7. Intellectual Property

7.1 Service Ownership

Vibe Typer retains all rights, title, and interest in the Service, including:

• Software code and algorithms
• User interface and design
• Service branding and trademarks
• Documentation and support materials

7.2 User Content

You retain ownership of content you create or input into the Service. By using the Service, you grant us a limited license to:

• Process your audio and text for transcription purposes
• Transmit your content as necessary to provide the Service
• Use aggregated, anonymized data for service improvement

8. Privacy and Data Protection

8.1 Privacy Policy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information.

8.2 Data Processing

By using the Service, you consent to:

• Processing of your audio data for transcription
• Storage of your account information and usage data
• Transfer of data to third-party service providers as needed to operate the Service (for example: hosting, authentication, billing, and inference providers)

8.3 Data Security

We implement reasonable security measures to protect your data, but cannot guarantee absolute security.

9. Third-Party Services

9.1 Integration Dependencies

The Service relies on third-party services including:

• Third-party inference providers for speech recognition and AI processing (we may switch providers automatically for reliability/performance)
• Third-party authentication and data storage providers
• Third-party billing providers (if you purchase a paid plan)
• Website analytics tools (for our marketing website)

9.2 Third-Party Terms

Your use of the Service is also subject to the terms of service of these third-party providers.

10. Disclaimers

10.1 Service Accuracy

• Transcription accuracy may vary based on audio quality and other factors
• AI-generated content may not always be accurate or appropriate
• You are responsible for reviewing and verifying all transcribed content

10.2 No Warranties

The Service is provided “as is” without warranties of any kind, including:

• Merchantability or fitness for a particular purpose
• Accuracy, reliability, or availability
• Non-infringement of third-party rights

11. Limitation of Liability

11.1 Liability Limits

To the maximum extent permitted by law, our total liability for any claims arising from your use of the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

We shall not be liable for:
